Terms of Service

These terms explain the rules for creating an account, using Myndora, and managing a paid subscription.

1. Who these terms are between

These Terms of Service (the “Terms”) are an agreement between you and Sam Buwalda, trading as Myndora (“Myndora”, “we”, “us”, or “our”). They apply when you create a Myndora account, purchase a subscription, or otherwise use the Myndora website and service at myndora.app (the “Service”).

By creating an account, you confirm that you have read and agree to these Terms. Our processing of personal data is explained separately in our Privacy Policy.

2. Eligibility and accounts

You must be at least 18 years old to create an account or use the Service. Myndora is currently offered to individuals for their own personal use. Business or organisational use requires a separate written agreement with us.

You must provide accurate account information, keep your login details confidential, and tell us promptly if you believe your account has been accessed without permission. You are responsible for activity performed through your account unless it resulted from a security failure for which we are responsible.

3. What Myndora provides

Myndora is a personal self-understanding service. It helps you build an evolving Living Profile from your answers and provides reflective information about recurring patterns, alignment, friction, roles, environments, and possible areas for development. Features may include the Living Profile, Profile Fit, History, recalibration, Ask Your Profile, and the consent-based Share & Compare feature. Share & Compare compares all 26 profile Areas using signals currently available in both participants’ profiles. It helps participants explore similarities and differences together. Any overall pattern alignment percentage summarizes current pattern similarity across those Areas; it does not assess whether participants are compatible and must not be used for consequential decisions about another person.

Myndora provides informational and reflective output. It is not a medical, psychiatric, therapeutic, diagnostic, clinical mental-health, recruitment, or professional career- counselling service. Its output is not a diagnosis, clinical assessment, employment recommendation, or guarantee of an outcome. You remain responsible for decisions you make.

Some output is generated or assisted by artificial intelligence. AI-generated content can be incomplete, inaccurate, or unsuitable for a particular situation. Treat it as one source of reflection and use independent professional advice when a decision has serious medical, legal, financial, employment, or other consequences.

4. Free and paid plans

Myndora may offer a free plan and one or more paid plans. The current features, limits, billing interval, and consumer price are shown on the Pricing pagebefore purchase. Consumer prices are shown in euros and include applicable VAT unless we clearly state otherwise.

Payments are processed by Stripe. The payment methods available to you are shown during checkout and may depend on your location and device. We do not receive or store your full payment-card number.

5. Subscriptions, renewal, and cancellation

A paid Myndora subscription renews automatically each month until you cancel it. Stripe charges the payment method selected during checkout at the beginning of each billing period. There is no paid-plan free trial unless one is expressly offered during checkout.

You can cancel future renewals at any time from Settings by opening the Stripe billing portal. Ordinary cancellation takes effect at the end of your current paid billing period, and you can continue using paid features until then.

We may change a subscription price for a valid business reason, but not during the first three months of a subscription. We will give at least 30 days’ advance notice before a price increase applies to a renewal. You may cancel before the new price takes effect.

6. Fourteen-day right of withdrawal and refunds

If you are a consumer in the European Economic Area, United Kingdom, or another jurisdiction that grants a statutory cooling-off right, you may withdraw from an eligible new paid Myndora subscription contract within 14 calendar days after the contract is concluded without giving a reason. Myndora refunds all eligible payments received under the withdrawn contract when you exercise this right in time. Your paid access ends when the withdrawal is processed.

If the final day falls on a weekend or recognised Dutch public holiday, the deadline moves to the next working day. If mandatory withdrawal information was missing or incomplete, the withdrawal period may be extended. An ordinary monthly renewal under the same subscription contract does not generally start a new withdrawal period. If you later conclude a separate new subscription contract, that contract may have its own withdrawal right.

Use the continuously available online withdrawal function. It does not require an account or login. You may also send any other unambiguous withdrawal statement to support@myndora.app or use the statutory model form supplied with your purchase confirmation. Include enough information to identify the contract. Myndora will acknowledge an online withdrawal on a durable medium with the statement’s content and submission date and time.

To meet the deadline, it is enough to send your statement before the applicable period expires. We refund through the original payment method, without fees, and no later than 14 days after receiving the withdrawal. Outside the applicable withdrawal period, ordinary cancellation stops future renewals but does not normally produce a partial-period refund. This does not limit any right you have when a digital service is defective, unavailable, misdescribed, or when applicable law otherwise requires a refund.

7. Acceptable use

You must not:

  • break the law or infringe another person’s rights while using the Service;
  • access another person’s account or share account credentials without authorisation;
  • interfere with security, probe for vulnerabilities, introduce malicious code, scrape the Service, or bypass usage limits;
  • pretend to be another person or submit another person’s answers without their informed permission;
  • submit confidential, sensitive, or personal information about another person unless you have a lawful right to do so;
  • sell or transfer your account or Living Profile;
  • use Myndora output to make or materially support consequential decisions about another person concerning employment, hiring, promotion, education, credit, insurance, housing, healthcare, or a similarly significant matter; or
  • copy, reverse engineer, or commercially exploit the Service except where applicable law expressly permits it.

8. Your answers and other input

You retain the rights you hold in information you submit to Myndora. You give us a limited, non-exclusive permission to host, transmit, reproduce, analyse, and otherwise process that information only as reasonably necessary to provide, operate, secure, and support the Service, comply with law, and act as described in the Privacy Policy. This permission does not transfer ownership of your input to Myndora.

Myndora does not provide a public posting area, social feed, or user-review feature. Your profile answers are not made public through the Service. If you explicitly connect through Share & Compare, both participants can see the derived comparison across all 26 profile Areas, but not each other’s individual answers or separate profile. Either participant may disconnect. An inviter may permanently delete a revoked invitation. Do not submit material that you do not have the right to provide.

If you voluntarily send product feedback or suggestions, you allow us to use that feedback to investigate and improve Myndora without payment or attribution. Account-linked feedback may include a technical snapshot of the question, result, or profile evidence you saw so we can understand it, as explained in the Privacy Policy. This does not give us ownership of your Living Profile or private answers.

9. Myndora intellectual property

The Service, including its software, design, branding, explanatory content, question system, and generated presentation formats, is owned by us or licensed to us and is protected by intellectual-property law. Subject to these Terms, we give you a limited, personal, revocable, non-transferable licence to use the Service for its intended purpose.

10. Privacy and service providers

How we collect, use, retain, and share personal data—including the use of Supabase, Vercel, OpenAI, Stripe, PostHog, and Resend—is explained in the Privacy Policy. International transfers, where applicable, are handled using the safeguards described there. Nothing in these Terms limits rights under applicable data-protection law.

The Service may link to third-party services. Their own terms and privacy notices apply when you use them. We are responsible for our choice and integration of processors to the extent required by applicable law, but we do not control unrelated third-party websites.

11. Availability and changes to the Service

We work to keep Myndora available and accurate, but interruptions, maintenance, and errors can occur. We may fix bugs, improve security, change features, or discontinue parts of the Service for valid reasons such as improving clarity, responding to technical constraints, preventing abuse, complying with law, or developing the product.

Changes will not add a charge without your express agreement. If a change has more than a minor negative effect on your access to a paid digital service, we will provide clear notice on a durable medium within a reasonable time and give you any termination or refund right required by law.

12. Suspension, termination, and account deletion

We may restrict or suspend an account when reasonably necessary to investigate security concerns, prevent harm, comply with law, or address a material breach of these Terms. Where reasonably possible, we will explain the reason and give you an opportunity to correct the issue before permanent termination.

If we terminate a paid Service without a breach by you, we will refund the unused prepaid portion where appropriate. We may terminate immediately for serious unlawful conduct, fraud, security abuse, or conduct that creates a material risk to Myndora or other people.

You can delete your account from Settings. Account deletion cancels an active Stripe subscription so that it will not renew and removes your Myndora account data, subject to limited records we must retain for legal, accounting, fraud-prevention, or dispute purposes. Because deletion ends access immediately, cancel through the billing portal instead if you want to retain paid access until the end of the billing period.

13. Warranties and responsibility

We will provide the Service with reasonable care and skill and in conformity with mandatory consumer law. Except for those mandatory rights, the Service is provided on an “as available” basis. We do not promise that every insight will be accurate, that the Service will always be uninterrupted, or that a particular personal, career, or other outcome will occur.

Nothing in these Terms excludes statutory conformity remedies, legal guarantees, or other consumer rights that cannot be waived by contract.

14. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the agreement was made. Our total aggregate liability arising from the Service will not exceed the greater of €100 or the amount you paid to Myndora during the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of mandatory consumer rights, or liability under applicable data-protection law.

15. Complaints and disputes

Please first contact support@myndora.app so we can try to resolve a complaint informally. We aim to acknowledge complaints promptly and provide a substantive response within 14 days where reasonably possible. Information about European consumer dispute-resolution bodies is available through the European Commission consumer redress portal.

16. Changes to these Terms

We may update these Terms for valid reasons, including changes to the Service, law, security, or our business. For a material change, we will send registered users the updated terms or a link to them by email or provide another durable notification at least 14 days before the change takes effect. You may stop using the Service and cancel a subscription before the effective date if you disagree.

Security fixes, bug fixes, or changes required urgently by law or a court order may take effect immediately. We will still explain the change as soon as reasonably possible. The effective date at the top identifies the version currently in force.

17. Governing law

These Terms are governed by Dutch law. If you are a consumer, this choice does not remove mandatory protections provided by the law of the country where you habitually reside. The courts of Rotterdam, the Netherlands, have non-exclusive jurisdiction, and an EU consumer may also bring a claim before the competent courts in their country of residence where the law permits.
